The software the Licensor makes available under these terms, including any portions of it.
The Software may only be used for non-competitive purposes. A "non-competitive purpose" is any use of the Software that does not compete with the Software or any product or service offered by the Licensor.
Subject to the Use Limitation, the Licensor grants you a non-exclusive, worldwide, royalty-free license to use, copy, modify, create derivative works, and redistribute the Software, in each case subject to the limitations and conditions in these terms.
On the second anniversary of the date the Licensor first made the Software available, the license granted above converts to the Apache License, Version 2.0 (the "Apache License"). You may then use the Software under the terms of the Apache License, and the Use Limitation no longer applies.
You agree that you will not, and will not assist, encourage, or enable others to, circumvent the Use Limitation.
These terms do not grant you any right to use the Licensor's name, logo, or trademarks.
The Licensor grants you a license, under any patent claims the Licensor can license or becomes able to license, to make, have made, use, sell, offer for sale, import, and have imported the Software, in each case subject to the limitations and conditions in these terms.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
