Terms and Conditions

1. Acceptance of Terms

By accessing, downloading, installing, or using the snmp-olt-zte software (ZTE C320/C300 SNMP monitoring adapter) ("Software"), you ("User", "you", or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Software.

2. License Grant

2.1 MIT License

This Software is licensed under the MIT License. The full license text is available in the LICENSE file in the repository.

2.2 Permissions

Subject to these Terms, you are granted the following rights:

  • Use: Run the Software for personal or commercial purposes
  • Copy: Make copies of the Software
  • Modify: Modify the Software to suit your needs
  • Distribute: Distribute copies of the original or modified Software
  • Sublicense: Grant sublicenses to others

3.2 Device Access

  • You must have legal authorization to access and monitor any ZTE C320 OLT or other network devices using this Software
  • Unauthorized access to network devices may violate laws including but not limited to the Computer Fraud and Abuse Act (CFAA) in the United States or equivalent laws in other jurisdictions
  • You are solely responsible for ensuring you have proper authorization before deploying this Software

4. Intellectual Property

4.1 Ownership

The Software is protected by copyright and other intellectual property laws. The original copyright holder retains all rights not explicitly granted under the MIT License.

4.2 Trademarks

"snmp-olt-zte", "CKT Dev", and any associated logos or branding are trademarks of their respective owners. Use of these trademarks requires prior written permission except as necessary for reasonable and customary use in describing the origin of the Software.

4.3 Third-Party Components

The Software includes or depends upon third-party open source components, each governed by their respective licenses:

  • Go (BSD-style license)
  • Chi Router (MIT License)
  • GoSNMP (BSD License)
  • Redis Go Client (BSD-2-Clause License)
  • Zerolog (MIT License)
  • And others listed in go.mod

5. Disclaimer of Warranties

5.1 "AS IS" Basis

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

5.2 No Guarantee

The copyright holders and contributors DO NOT WARRANT that:

  • The Software will meet your requirements
  • The Software will be uninterrupted, timely, secure, or error-free
  • The results obtained from the use of the Software will be accurate or reliable
  • The quality of the Software will meet your expectations
  • Any errors in the Software will be corrected

5.3 Network Monitoring Risks

You acknowledge that:

  • Network monitoring software may not capture all events
  • SNMP data may be incomplete, delayed, or inaccurate
  • The Software should not be relied upon as the sole source of truth for network monitoring
  • Critical infrastructure should have redundant monitoring systems

6. Limitation of Liability

6.1 No Liability for Damages

IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

6.2 Specific Exclusions

This limitation of liability includes, but is not limited to:

  • Direct, indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Business interruption
  • Network outages or service disruptions
  • Security breaches or data loss
  • Damage to equipment or systems
  • Third-party claims

6.3 Maximum Liability

To the maximum extent permitted by applicable law, the total liability of the copyright holders and contributors shall not exceed the amount you paid for the Software (which is zero for free distributions).

7. Indemnification

You agree to indemnify, defend, and hold harmless the copyright holders, contributors, and their respective affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

  1. Your use of the Software
  2. Your violation of these Terms
  3. Your violation of any third-party rights, including without limitation any copyright, property, or privacy right
  4. Your violation of any applicable law or regulation

8. Data Privacy

8.1 Data Processing

The Software processes network device data, which may include:

  • Device identifiers (ONU IDs, serial numbers)
  • Network addresses (IP addresses)
  • Device status and performance metrics
  • Timestamps

8.2 Your Responsibilities

You are the data controller for any personal data processed using the Software. You are responsible for:

  • Ensuring lawful processing of data
  • Obtaining necessary consents
  • Complying with applicable data protection laws (GDPR, CCPA, etc.)
  • Implementing appropriate security measures
  • Honoring data subject rights

8.3 No Data Collection by Us

The Software does not transmit any data to the copyright holders or contributors. All data remains within your infrastructure.

9. Updates and Modifications

9.1 Software Updates

  • The Software may receive updates, patches, or new versions
  • You are not obligated to install updates
  • We reserve the right to discontinue support for older versions
  • Updates may include breaking changes

9.2 Terms Updates

  • These Terms may be updated from time to time
  • Continued use of the Software after changes constitutes acceptance
  • Material changes will be announced via GitHub releases or repository README
  • Check the "Last Updated" date at the top of this document

10. Termination

10.1 Termination by You

You may terminate your use of the Software at any time by:

  • Ceasing to use the Software
  • Deleting all copies from your systems
  • Uninstalling the Software from all servers

10.2 Termination by Us

We reserve the right to:

  • Discontinue development of the Software at any time
  • Terminate distribution of the Software
  • Revoke your rights under these Terms if you violate them

10.3 Effect of Termination

Upon termination:

  • Your right to use the Software ceases
  • You must destroy all copies of the Software in your possession
  • The MIT License grant survives for copies you have already distributed

11. Export Control

11.1 Export Compliance

You acknowledge that the Software may be subject to export control laws and regulations. You agree to comply with all applicable export and import laws and regulations in your use of the Software.

11.2 Prohibited Destinations

You may not use, export, or re-export the Software:

  • To any country subject to a U.S. embargo or sanctions
  • To anyone on the U.S. Treasury Department's list of Specially Designated Nationals
  • To anyone on the U.S. Department of Commerce Denied Persons List or Entity List
  • For any prohibited end-use, including nuclear, chemical, or biological weapons development

12. Governing Law

12.1 Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the copyright holder resides, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising from these Terms or the Software shall be resolved through:

  1. Good faith negotiation between the parties
  2. Binding arbitration if negotiation fails
  3. Litigation as a last resort

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

14. Entire Agreement

These Terms, together with the MIT License, constitute the entire agreement between you and the copyright holders regarding the Software and supersede all prior agreements and understandings.

15. No Waiver

The failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16. Assignment

You may not assign or transfer these Terms or any rights granted hereunder without prior written consent. The copyright holders may assign these Terms at any time without notice.

17. Support and Maintenance

17.1 No Obligation

The copyright holders are under no obligation to provide:

  • Technical support
  • Bug fixes
  • Security updates
  • Feature enhancements
  • Documentation updates

17.2 Community Support

Support may be available through:

  • GitHub Issues (community-driven)
  • GitHub Discussions
  • Pull requests (community contributions)

18. Use in Critical Systems

18.1 Not for Safety-Critical Systems

THE SOFTWARE IS NOT DESIGNED, MANUFACTURED, OR INTENDED FOR USE IN ENVIRONMENTS REQUIRING FAIL-SAFE PERFORMANCE, INCLUDING:

  • Nuclear facilities operation
  • Aircraft navigation or communication systems
  • Air traffic control systems
  • Life support machines
  • Weapons systems
  • Critical infrastructure protection systems

18.2 High-Risk Activities

Use of the Software in such environments is at your own risk. The copyright holders disclaim all liability for any damages resulting from such use.
